Highbridge Condominium Association retains Leib & Katt, LLC
Leib & Katt has been retained in the high profile case of Highbridge Condominium Association v. New Land Enterprise, et al., to represent a material supplier. The plaintiff in this alleged building defect case is alleging damages, which exceed $6 million.
Attorneys William Katt and Mark Malloy prevail at Supreme Court in Shell Lake Case
Attorneys William Katt and Mark Malloy received a successful ruling from the Wisconsin Supreme Court in a case originally venued in Sawyer County, Wisconsin. The action arose out of a lake discharge project in Shell Lake, Wisconsin, which was designed to eliminate high lake water levels. Unfortunately, problems developed with the system after it was activated. The case was brought by over 30 homeowners who sought to certify the action as a class action. Attorneys Katt and Malloy led the defendant’s motion to defeat class certification, and class certification was denied. The case was ultimately dismissed based alternatively on lack of duty and public policy grounds. On July 13, 2006, the Wisconsin Supreme Court affirmed the trial court’s ruling, holding that the homeowner plaintiffs’ claims were barred by public policy.
