Shell Lake Discharge Project

Attorney Bill Katt was retained by a national HDPE storm sewer pipe manufacturer to represent the company in two actions arising out of the Shell Lake Discharge Project. This project was designed to eliminate high lake water levels on Shell Lake, which allegedly caused damage to city property and nearby lake homes.

Attorneys Bill Katt and Mark Malloy of Leib & Katt were successful in persuading the trial court not to certify the claims by the homeowners as a class action. They also successfully fought for a change of venue. Finally, they developed a discovery plan, which brought all sides to the table, resulting in the settlement of the city’s case.
