M&S Transportation
M&S Transportation, a school bus company, was sued after a seven-year-old boy ran in front of a bus and was hit by an uninsured driver. The plaintiffs alleged that the bus driver did not properly warn the boy or observe traffic before allowing the boy to exit the bus. He remained confined to a wheelchair and unable to speak. Despite the extreme injuries and sympathy for the family, a defense verdict was rendered with the jury finding the boy 55% negligent. Under Wisconsin law, his negligence served as a bar to any recovery because it exceeded that of the defendants.
